1. Purpose

This Trademark Policy governs the use of trademarks owned by Neural-LLM ("Neural-LLM," "we," "our," or "us"), the nominative fair use of trademarks owned by Anthropic, PBC and other third parties in Neural-LLM's materials, and the rights and responsibilities of third parties who wish to reference Neural-LLM's marks.

This policy is published to:

  • Define Neural-LLM's proprietary marks and assert Neural-LLM's ownership;
  • Clarify the basis on which Neural-LLM uses third-party marks, in particular those owned by Anthropic, PBC;
  • Provide clear guidance to third parties on permitted and prohibited uses of Neural-LLM's marks; and
  • Prevent consumer confusion, dilution, and unauthorized commercial exploitation of Neural-LLM's brand equity.

2. Neural-LLM's Own Marks

2.1 Owned Trademarks

The following marks are owned by Neural-LLM:

| Mark | Form | Registration Status | |---|---|---| | Neural-LLM | Word mark | [JURISDICTION_PLACEHOLDER: USPTO application or registration number, or "unregistered common-law mark in use since [date]"] | | Power Claude | Word mark | [JURISDICTION_PLACEHOLDER: USPTO application or registration number, or "unregistered common-law mark in use since [date]"] | | Neural-LLM logo | Design mark | [JURISDICTION_PLACEHOLDER: USPTO application or registration number, or "unregistered common-law mark in use since [date]"] | | Power Claude logo | Design mark | [JURISDICTION_PLACEHOLDER: USPTO application or registration number, or "unregistered common-law mark in use since [date]"] |

2.2 General Rules for Neural-LLM's Marks

Whether or not expressly licensed, all uses of Neural-LLM's marks by any party (including Neural-LLM itself) must:

  • Not falsely imply affiliation, sponsorship, or endorsement that does not exist;
  • Not be used in a manner likely to cause confusion as to the source, origin, or quality of goods or services;
  • Maintain the mark's integrity — do not alter, distort, abbreviate, or combine Neural-LLM's marks with other words or symbols in a way that creates a new composite mark without written authorization; and
  • Include appropriate trademark attribution in materials that use the marks (e.g., "Neural-LLM and Power Claude are trademarks of Neural-LLM").

3. Third-Party Marks Used by Neural-LLM

3.1 Anthropic, PBC Marks

"Claude," "Claude Code," and "Anthropic" are trademarks or registered trademarks of Anthropic, PBC. Neural-LLM uses these marks in its product name ("Power Claude"), documentation, website, and marketing materials under the nominative fair use doctrine.

Neural-LLM's use of Anthropic's marks is:

  • Descriptive, not source-identifying — "Claude" and "Claude Code" appear in Neural-LLM's materials solely to identify the Anthropic products with which Power Claude interoperates;
  • Not a claim of partnership, sponsorship, or endorsement — Neural-LLM is not affiliated with, endorsed by, or connected to Anthropic, PBC in any way; and
  • Not a use of Anthropic's logos, stylized branding, or trade dress — Neural-LLM uses only the plain-text word marks "Claude" and "Claude Code" in descriptive contexts.

The legal basis for this nominative fair use is the three-prong test articulated in New Kids on the Block v. News America Publishing, Inc., 971 F.2d 302 (9th Cir. 1992):

  1. Necessity: Power Claude cannot practically be identified without reference to Anthropic's "Claude Code" trademark — there is no practical alternative name that accurately describes the Anthropic product with which Power Claude interoperates.
  2. Proportionality: Neural-LLM uses only so much of the mark as is reasonably necessary to identify the Anthropic product — plain text only, no Anthropic logos, stylized elements, or trade dress.
  3. Non-suggestion of endorsement: Neural-LLM takes affirmative steps to prevent any suggestion of Anthropic endorsement — the non-affiliation disclaimer appears prominently on every product surface, explicitly stating that Anthropic is not affiliated with, does not endorse, and does not sponsor Neural-LLM or Power Claude.

This fair-use analysis is informational. Neural-LLM should obtain qualified trademark counsel to confirm its fair use position before commercial launch and periodically thereafter.

Nothing in this policy grants any rights in Anthropic's marks to Neural-LLM's licensees or customers. Third parties who wish to use Anthropic's marks must independently comply with Anthropic's own trademark guidelines (see https://www.anthropic.com/).

3.2 Microsoft Corporation Marks

"Visual Studio Code" and "VS Code" are trademarks of Microsoft Corporation. Neural-LLM uses these marks solely to indicate that the Extension is distributed on the Visual Studio Code Marketplace and operates within the VS Code development environment. This use is descriptive and does not imply affiliation with or endorsement by Microsoft Corporation.

3.3 Trademark Attribution Table

| Mark | Owner | Neural-LLM's Basis for Use | |---|---|---| | Claude™ | Anthropic, PBC | Nominative fair use — identifies the Anthropic product with which Power Claude interoperates | | Claude Code™ | Anthropic, PBC | Nominative fair use — identifies the Anthropic CLI product with which Power Claude interoperates | | Anthropic™ | Anthropic, PBC | Nominative fair use — identifies the company whose API Power Claude operates on top of | | Visual Studio Code™ | Microsoft Corporation | Nominative fair use — identifies the distribution channel and host IDE | | VS Code™ | Microsoft Corporation | Nominative fair use — abbreviation for the above |

All other third-party marks referenced in Neural-LLM materials are the property of their respective owners. Their use is descriptive only and does not imply any affiliation.

4. Permitted Third-Party Uses of Neural-LLM's Marks

The following uses of Neural-LLM's marks by third parties are permitted without prior written authorization, provided they comply with the General Rules in Section 2.2 and do not fall within the Prohibited Uses in Section 5:

4.1 Editorial, Journalistic, and News Reporting

Journalists, bloggers, analysts, and other editorial content creators may use the marks "Neural-LLM" and "Power Claude" to accurately identify and discuss Neural-LLM and its products in editorial, news, review, or commentary content.

Permitted examples:

  • A product review article titled "Power Claude Review: Does It Eliminate Claude Rate Limits?"
  • A news item reporting that "Neural-LLM launches Power Claude for VS Code"
  • An analyst report comparing developer AI tools that includes Power Claude in the comparison

Requirements: The use must be accurate and not misleading, must not imply endorsement by Neural-LLM, and must include appropriate context clarifying that Power Claude is not affiliated with Anthropic where relevant to avoid misleading readers.

4.2 Educational and Academic Use

Educational institutions, instructors, students, and researchers may use Neural-LLM's marks in academic papers, course materials, conference presentations, and non-commercial educational content that accurately discusses Neural-LLM's products.

4.3 Nominative Comparative Advertising

A third party may identify Neural-LLM's products by name when making truthful, non-misleading comparative claims about competing products, provided:

  • The comparison is factually accurate and verifiable;
  • The use does not imply affiliation, sponsorship, or endorsement by Neural-LLM; and
  • The use does not create a likelihood of confusion between the third party's products and Neural-LLM's products.

4.4 Personal, Non-Commercial Commentary

Individuals may use Neural-LLM's marks in personal, non-commercial online commentary (social media posts, forum posts, personal blog posts) to express opinions about Neural-LLM or its products. Non-commercial parody is permitted where it is clearly identifiable as parody and not likely to mislead consumers into thinking it is official Neural-LLM content.

4.5 Compatibility and Integration Statements

Third-party developers may state that their own product "works with Power Claude" or "is compatible with Power Claude" where this is factually accurate. Such statements must be limited to identifying the compatibility relationship and may not imply endorsement, certification, or partnership with Neural-LLM.

5. Prohibited Uses of Neural-LLM's Marks

The following uses are prohibited without Neural-LLM's prior written authorization:

  1. Commercial endorsement claims — using Neural-LLM's marks in advertising, marketing, or promotional materials in a way that implies Neural-LLM has endorsed, certified, or partnered with the third party;
  1. Product naming or branding — incorporating "Neural-LLM," "Power Claude," or confusingly similar variants (e.g., "Power Claude Pro," "NeuralLLM Cloud," "Power Claude Enterprise") into the name or brand of a third-party product or service;
  1. Domain names and social media handles — registering domain names or social media handles that incorporate Neural-LLM's marks or confusingly similar variations (e.g., powerclaude.com, power-claude.net, @powerclaudeofficial) without Neural-LLM's authorization;
  1. Merchandise and physical goods — using Neural-LLM's marks on apparel, stickers, merchandise, or other physical goods without a written license;
  1. Modified or derivative marks — creating logos, stylized text, or composite marks that incorporate or are confusingly similar to Neural-LLM's marks;
  1. Context implying official source — using Neural-LLM's marks in a context that could reasonably cause a consumer to believe that content, software, or services are officially from Neural-LLM when they are not;
  1. Competing product development — using Neural-LLM's marks in a manner that implies Neural-LLM has authorized or is associated with a competing product;
  1. Trademark registration — registering or attempting to register "Neural-LLM," "Power Claude," or confusingly similar marks as trademarks or service marks in any jurisdiction; and
  1. Defamatory or obscene contexts — using Neural-LLM's marks in a defamatory, obscene, or otherwise objectionable manner that damages the marks' reputation or goodwill.

5.1 Domain and Social Handle Policy

Domain names and social media handles that incorporate Neural-LLM's marks are exclusively reserved for Neural-LLM and its authorized agents. Neural-LLM owns neural-llm.com and the official VS Code Marketplace publisher identity for Power Claude. Cybersquatting — registering domain names or handles that incorporate Neural-LLM's marks with bad-faith intent to profit — is a violation of the Anticybersquatting Consumer Protection Act (15 U.S.C. § 1125(d)) and analogous laws in other jurisdictions. Neural-LLM will actively pursue cancellation, transfer, or injunctive relief for infringing domains and handles through UDRP proceedings or court action.
